Building plan clearance to additions & alterations to monuments.
Explanatory Notes for Building Plan Clearance to Additions & Alterations to Monuments
Under the powers conferred by the Planning (Development) Rules, the Competent Authority hereby requests that all applications for Building Plan Clearance for additions & alterations to existing or proposed monuments be made in accordance with the following requirements, prior to submitting plans for Building Plan Approval from the Building & Construction Authority.
1. Description of proposed development
In the Form DC30, the applicant should state clearly that his application is for Building Plan Clearance to carry out additions and alterations to existing or proposed monuments prior to submitting plans for Building Plan Approval from the Building & Construction Authority.
APPLICATION FORMS
i. | Every application for building plan clearance to existing or proposed monuments must be made on the prescribed application form. |
ii. | A letter of consent from the land owner(s) must be obtained. Where an option to purchase the land has been exercised, the application must be accompanied by a letter of consent from the owner or the owner's solicitor. |
iii. | All statistical entries to the form must be clearly annotated. |
iv. | The application must be accompanied by the Land Title Declaration Form. |
2. Plans to be submitted
Every application must be accompanied by:

i. | Proposal Plan | |
a. | The proposal plan must be a true cadastral and topographical representation of the land concerned in the application, clearly indicating the existing building(s) and the proposed additions and alterations in distinctive colours. | |
b. | The proposal plan shall be drawn to scale as appropriate. Building (existing and proposed extension) setbacks from the lot boundaries need to be clearly indicated. | |
c. | If additional car parks are required, they shall be clearly demarcated on the proposal plan or the sketch plan depending on their location. | |
ii. | Sketch plan | |
a. | Sketch floor and elevational plans shall be drawn to scale as appropriate. | |
b. | The proposed additions and alterations to the existing building(s) shall be clearly indicated with distinctive colours in the sketch floor and elevational plan. | |
c. | The use of the existing building(s) and the proposed extension shall be indicated on the sketch floor plans. | |
3. Definition of Owner
"Owner" in relation to land or premises is defined in the Planning Act (Cap 232, 1998 Ed) as the person for the time being receiving the rent of the land or premises whether on his own account or as trustee for any other person or as receiver (not being appointed by or on behalf of a mortgagee) or the person who would receive the rent if the land or premises were let to a tenant and includes --
a mortgagee in possession; and
the purchaser of any newly constructed premises or part thereof in respect of which a temporary occupation permit or a certificate of statutory completion has been granted.
4. List of deviation (1 copy)
The proposed works in the Building Plan should be similar to the Approved Plans in the Planning Permission from the Competent Authority. For items not complied with, the reasons justifying the deviations are to be clearly explained in the list of deviations for evaluation and whether Amendments to Approved Plans are required to be submitted to the Competent Authority for further planning permission. Supporting documents, photos are to be attached if applicable, to support the deviations.
5. General
General information
i. | In order that the application can be processed quickly, all particulars relevant to the proposed development should be given. The Competent Authority may also request additional information on the application under consideration. Applicants may wish to include items which have failed to comply with the current planning requirements by completing the list of deviation. |
