List of allowable uses on upper floors of mixed-use developments
Home Office
Student Care Centre
Home for the Aged
Community Institution use (e.g. association, family service centre, community library)
Students' Hostel*
Serviced Apartment*
Hotel Use*
Office**
Commercial School#
* These uses will be considered on a case-by-case basis.
** Office use may require clearance from LTA if there are traffic or parking concerns.
# Commercial school use is only allowed for some selected streetblocks.
These uses give owners and tenants more options and flexibility in using the upper floors of their premises, while ensuring that such uses do not cause a negative impact on the immediate neighbourhood.
Where does this apply?
The above list of uses is only applicable to existing developments on selected sites which are zoned "Residential with Commercial on First Storey Only" and "Commercial & Residential". The identified developments can be found in Appendix A [PDF, 2.63 MB].
The list of uses does not apply to the following:
Existing rear extensions of conserved buildings which are already designed with appropriate separation of residential units from commercial uses
Mixed use developments which have been redeveloped and designed with appropriate separation of residential units from the commercial uses
Mixed use developments undertaking Additions & Alteration works or redevelopment which will result in an increase in Gross Floor Area (GFA).
Conditions for Approval
Operators of the new uses must ensure that the activities of their businesses do not cause disturbance to the neighbours or the residential neighbourhood. New uses will be granted either a 1-year or 3-year temporary permission (TP) with a condition to terminate the permission if the use results in disamenity.
The permission may be renewed at the end of the TP if the new uses do not create disamenity to the surrounding residents.
