CIRCULAR TO PROFESSIONAL INSTITUTES
For conservation buildings, there have been instances where the Qualified Person (QP) submitted to the Building and Construction Authority (BCA) building plans that differ from the plans granted Conservation Permission by URA as the Competent Authority. Such discrepancies have led to delays in project completion and costly rectifications to owners when they were discovered later.
To eliminate such incidents, Section 15(2) of the Planning Act (Cap 232) has been amended for the Competent Authority to require a QP to submit a declaration at the building plan submission stage. The QP has to declare that the proposed building works for the conservation building submitted to the BCA are in accordance with the plans approved by the Competent Authority.
The requirement to submit the declaration takes effect from 1 June 2004 as a condition in the Conservation Permission. The QP has to submit the declaration to both URA and BCA, before BCA can accept the building plans for processing. With the requisite declaration, URA can later issue TOP/CSC Clearance to the completed works. A copy of the declaration form for the QP's use is attached.
For the purpose of this declaration,
the QP must be a person who is registered as an architect under the Architects Act (cap 12) and who has in force a practising certificate issued under that Act; and
minor changes which have been exempted by URA from amendment plan submission in Circular No URA/PB/2001/03-CUDD dated 31 Jan 2001 (seeAnnexure 1) are not considered as deviations from the plans granted Conservation Permission. Such changes can continue to be incorporated into the building plans submitted to BCA and are deemed to be in accordance with the plans approved by the Competent Authority.
