There are developers who in the course of seeking the Controller's approval for amendments to the standard Sale and Purchase agreements (Forms D & E) prescribed under the Housing Developers Rules, do not list notes inserted in the Specifications Of The Building ("Specifications") in a separate schedule, together with all other variations to prescribed form.
In our earlier circular of 25 Mar 2000, variations to prescribed form are required to be listed in a separate schedule. This is to ensure that approved variations to the standard clauses are made transparent to purchasers before they enter into a Sale and Purchase agreement. Amendments to the prescribed forms require the Controller's written approval under Rule 12 of the Housing Developers Rules.
We request your assistance to remind your members that notes inserted in the Specifications are to be listed in a separate schedule together with any other amendments to the prescribed form, in a similar manner specified under our circular of 25 Mar 2000 for approved variations, when they seek the Controller's approval.
Please also bring to the attention of your members the enclosed Annex A which contains notes to the Specifications which have been pre-approved. The pre-approved notes can be adopted in the prescribed forms without obtaining further approval from the Controller.
Examples of notes that will not be allowed are in Annex B.

Notes To The Specifications Pre-approved By The Controller
Marble & Granite
Marble and granite are natural stone materials containing veins with tonality differences. There will be colour and markings caused by their complex mineral composition and incorporated impurities. While such materials can be pre-selected before installation, this non-conformity in the marble or granite hence cannot be totally avoided. Granite tiles are pre-polished before laying and care has been taken for their installation. However granite, being a much harder material than marble cannot be re-polished after installation. Hence some differences may be felt at the joints.
Cablevision
The Purchaser is liable to pay annual fee, subscription fee and such other fees to the Singapore Cable Vision Ltd (SCV) or any other relevant authorities. The Vendor is not responsible to make arrangements with SCV for the service connection for SCV subscription channels.
Warranties
Where warranties are given by the manufacturers and/ or contractors and/ or suppliers of any of the equipment and / or appliances installed by the Vendor at the *Unit/ Building, the Vendor shall assign to the Purchaser such warranties at the time when possession of the*Unit/ Building is delivered to the Purchaser.
Timber
Timber strips are natural materials containing veins and tonal differences. Thus it is not possible to achieve total consistency of colour and grain in their selection and installation.
Wardrobes, Kitchen Cabinets and Fan Coil Units
Layout/Location of wardrobes, kitchen cabinets and fan coil units are subject to Architect's sole discretion and final design.

Notes To The Specifications That Will Not Be Approved By The Controller
Warranties
PROVIDED ALWAYS that the Vendor shall not be liable nor be answerable or responsible to the Purchaser for any failure on the part of the manufacturers and/or contractors and/or suppliers to maintain or repair for any defects.
(NB: Not approved to form part of the pre-approved notes for Warranties)
Brand and Model
The choice of type, brand, colour and model of materials, fittings, equipment and appliances supplied shall be subject to Architect's selection, market availability and the sole discretion of the Vendor
