Renting Property

If you own a private residential property and wish to rent it out, you must adhere to the following rules.

Minimum Stay Duration

All occupants are to fulfil a minimum stay duration of three consecutive months.

You are not allowed to rent out your property for use as Short-Term Accommodation e.g. on a daily or weekly basis.

Private residential properties smaller than 90sqm are subject to an occupancy cap of six unrelated persons per property. [See section on temporary relaxation for larger properties below]

Unrelated persons refer to anyone who is not part of the same family unit.

Domestic helpers are considered part of the same family unit.

The occupancy cap also applies to tenants who sublet the property. As the property owner, you must ensure that your tenants follow the rules.

From 22 Jan 2024 till 31 Dec 2026, there will be a temporary relaxation of the occupancy cap to allow up to eight individuals. This is applicable only to larger private residential properties of at least 90sqm strata / lot area. Owners of eligible properties must first register their property, together with payment of a $20 registration fee, to qualify for the higher occupancy cap. Before proceeding to register their property, owners are to ensure that:

  1. The property is already approved for residential use.
  2. The property has a minimum lot area of 90sqm. Property owners can validate their property size via  SLA’s e-service
  3. No previous registration for authorisation for a relaxation of the occupancy cap for the property has been cancelled over the last 12 months (or such shorter period as the Urban Redevelopment Authority specified in writing).  
  4. The property to be registered is a private residential property and in the case of Executive Condominiums, the relevant Minimum Occupation Period prescribed by HDB has already been fulfilled.

Property owners can be liable for infringements at their properties. The registration will be cancelled and the authorisation will cease if the occupancy cap of eight individuals is exceeded and/or where the additional occupancy creates serious nuisance. This is in addition to further enforcement actions that may be taken against property owners.

Registration of Tenants

For private properties, it is not necessary to register the tenants (e.g., name of occupants) with URA. Owners should check with their respective MCSTs if there are specific by-laws requiring such registration of tenants for their developments.
