Fresh applications which are made when the use has already started will be subject to payment of civil penalty for the contravention of Section 12 of The Planning Act (Cap 232, 1998 Ed). Civil penalty payable for unauthorised works are as set out in Table 1 (for Non-Conservation cases) and Table 2 (for Conservation cases). If the penalty is not paid within the 30-day period, the Competent Authority will refuse written permission for the retention of the use and the processing fee which you had paid earlier for the application will not be refunded. The Competent Authority will also proceed to take enforcement action.
